Action Alert: Ohio Patriot Act, WTF?!?!?!?

Our legislature, in their infinite wisdom, has decided to draft legislation to enact is own Patriot Act, as if the federal Patriot Act wasn't enough.

The highlights, courtesy of the Ohio ACLU, include:
· Requiring all state employees comply with the USA PATRIOT Act and with all executive orders regarding homeland security, even if doing so would require them to violate another law.


Loyalty oaths from the Red Scare period ring a bell?


· Prohibiting municipalities from enacting Bill of Rights or anti-PATRIOT Act resolutions that might interfere with terrorism or immigration law enforcement.


Slap in the face of local government much?


· Requiring people to disclose whether they have given material support to terrorism related organizations, even if they don’t know and cannot reasonably been expected to know they’ve done it.


How are they going to force you to disclose this information; threaten you with jail time if you refuse to answer? Sounds like a potential due process violation or 5th amendment violation somehow.


· Requiring you to provide your name, address, or date of birth to a law enforcement officer who suspects that you have committed or are about to commit a crime, or that you have witnessed a felony offense of violence.


This one has the potential to incite a lot of violence because it is likely to increase racial profiling, which will exacerbate all ready tense race relations in Cincinnati. I am quite sure that this will lead to many instances of the following scenario: Officer sees group of black or latino youths. Officer will ask for identification, say the group was acting suspiciously to justify a search, and detain the entire group or worse.

This bill was introduced on 01/25/05, so I'm not sure how much time we have to try to stop this. Let's get the ball rolling; write your state representatives ASAP and tell your friends to do the same. Click on the title link above to find out how.
